$2.5 Million for Accident Victim of Runaway Car at Auto Auction

Whiting Law Group secured a major settlement of $2.5 million on behalf of a Plaintiff struck down and severely injured by a runaway car at an auto auction in Crestwood, IL. Founder and Managing Partner, Timothy M. Whiting, lead the firm’s aggressive litigation of this auto accident settlement.

This complex case presented a number of difficulties due in part to the sheer number of crash victims —15 in total. Mr Whiting, the firm’s auto accident lawyers and its team of auto accident experts diligently worked the case for more than four years. The firm spent hundreds of thousands of dollars to test vehicles and retain leading engineering experts to prove that the Defendant’s vehicle ran away due to driver error – and not as a result of mechanical error. As the case progressed to trial, and with jury selection already under way, the Defendant offered to settle after admitting to liability in the case.

On March 18, 2008, the Plaintiff, Mr Adan Ornelas, was a car dealer attending an auto auction at the place of business of the Defendant, Tri-State Auto Auction. The Plaintiff alleged the Defendant failed to take reasonable actions to bring a Land Rover sport utility truck on auction safely to a stop, so as to avoid striking the Plaintiff.

As a result of being run over by the Defendant, Adan Ornelas suffered severe injuries to his legs and back. Throughout litigation, the Defendant argued that Mr Ornelas had made a good medical recovery and that he could return to work. The Defendant further held that Mr Ornelas would only need one knee replacement. To counter that medical claim, Whiting Law Group’s own top medical expert testified that the Plaintiff may in fact need multiple knee replacement surgeries in the future. The firm also demonstrated that Mr Ornelas never was able to return to work.
