The fatal trucking accident occurred in Oklahoma and the firm filed suit in California. On December 18, 2008, the Defendant was driving a semi-truck in the eastbound direction on Interstate 40 in the city of Sayre, Oklahoma. The Plaintiff, Aleksander Nikolic, was driving a different semi-truck eastbound on the same Interstate 40 in the city of Sayre, Oklahoma. The Defendant lost control of his semi-truck, causing it to run into the median, roll over and subsequently block all eastbound lanes of traffic on Interstate 40. As a result of the Defendant’s vehicle blocking all eastbound lanes of traffic, the Plaintiff collided with the Defendant’s vehicle. The Plaintiff was killed instantly. He was survived by his wife and two adult children.
