$1.07 Million Settlement for Construction Worker Injured by OSHA Violation

Whiting Law Group, through its attorneys Sara M. Davis and Timothy M. Whiting won a seven-figure settlement for a construction worker with the Laborers’ International Union of North America who was severely injured in a construction accident in 2008.

A member of Local 25, Lloyd Henry was working as a laborer on a construction site in Chicago when he stepped in a manhole that was improperly covered. The manhole cover did not meet OSHA standards – standards that help ensure that construction sites are as safe as possible for workers. As a result of his fall, Mr. Henry suffered an extremely painful and career-ending back injury. His medical treatment included a number of surgeries over a two-year period.

With Ms. Davis and Mr. Whiting co-leading the pursuit of justice on behalf of Mr. Henry, the firm retained proved that Mr. Henry suffered substantial pain and suffering, had significant lost wages and was, in fact, no longer able to work in the construction industry.

With a growing reputation as a leading construction accident attorney, Sara Davis offered her reflections on securing $1.07 million for Mr. Henry:

“This really was a case of the little guy against a big construction company. Our client was severely and permanently injured while working on a construction site. We fought for justice for him – and in the end, justice prevailed.”

The firm has also won numerous cases that were either settled or tried before a jury, resulting in over $120 million in recovery for the firm’s clients over the past decade.
