The Nuts and Bolts of Cargo Loading and Securement

Earlier this month, I delivered a presentation entitled The Nuts and Bolts of Cargo Loading and Securement at APITLA’s national conference. APITLA, the Association of Plaintiff Interstate Trucking Lawyers of America, is a leading organization of truck accident trial lawyers focused on improving the safety of the truck industry through education, legislation and litigation. APITLA’s yearly gathering was held in St. Louis over the weekend of May 16-17, 2015.

For the second year in a row, I was invited to deliver a presentation. For 2015, I was asked to speak about cargo loading and securement. As I have written previously, improper loading is one of the five most common causes of truck accidents, and is a terrible danger that I’ve seen time and time again in my clients’ personal injury cases.

5 Step Guide to Evaluating and Litigating Cargo Loading and Securement Cases

During my seminar, I walked the room full of personal injury and truck accident lawyers through my approach to evaluating and litigating cargo loading and securement cases. Through my presentation, I highlighted the following five key steps:

  1. Evaluate all the players involved and their possible negligence
  2. Identify relevant FMCSRs and OSHA regulations
  3. Be familiar with applicable case law
  4. Conduct appropriate discovery
  5. Assemble the right team of experts

If you are a personal injury attorney considering a cargo case for your client, I welcome the opportunity to chat through the case with you.

America’s Top Trial Lawyers

The national conference of APITLA is an opportunity for the leading truck accident attorneys from across the country to get together, to share best practices and to learn from one another. As a member of the National Advisory Board of APITLA, I consider the conference one of my most important engagements of the year. I always return from the APITLA conference having learned something very valuable.
