On March 1, 2003, the Plaintiff died when Defendant’s truck struck Plaintiff and ran over him while Plaintiff was crossing Manheim Road. The collision was witnessed by the Defendant driver and his passenger who both testified that Plaintiff threw himself in front of the truck. Police officers investigating the scene concluded that Plaintiff committed suicide by throwing himself in front of the truck based on those witness statements and based on Plaintiff giving up his wallet and keys (“worldly possessions”) to his friend minutes before crossing Manheim Road. Defendants argued that Plaintiff committed suicide.
