Preparing for a Truck Accident Trial

As previously discussed, Whiting Law Group has an experienced team that moves quickly when retained by clients in truck accident cases. After the firm’s lawyers and team of industry experts secure evidence and complete the initial steps discussed in the previous post, Whiting Law Group prepares for trial with a strong array of subject matter experts, technological analysis and years of experience in the litigation of trucking accident cases.
As part of this series of blog posts, we have discussed the prevalence of trucking accidents in the USA, the need for rapid action in representing the injured party and the initial steps to be taken in filing suit.

After the trucking accident investigation process is complete, Whiting Law Group evaluates the facts of the case and, depending on the specific issues of liability and damages, retains additional experts specializing in the issues involved.

For instance, if the trucking accident case involved a nighttime collision in which a tractor trailer jackknifed and blocked the roadway, we will retain an expert in truck conspicuity to establish the visibility of the stationary tractor trailer as it blocked the road. This expert can establish facts regarding the clients’ ability to perceive that something was present on the darkened road ahead, to identify that object as a large truck and to appreciate the truck’s position and the imminent danger it posed.

From a damages standpoint, litigating a truck case often requires numerous experts to testify regarding the devastating losses. By regulation, commercial trucks are permitted to weigh up to 80,000 pounds, as compared with private passenger vehicles that typically weigh between 2,500 and 5,000 pounds. This overwhelming disparity in the mass often means that the consequences of being hit by a moving truck, or striking a stationary truck, are frequently catastrophic.

Our trucking accident trial team includes a trauma surgeon, neurosurgeon, orthopedist, radiologist, neurologist, neuropsychologist, physical medicine specialist and all other necessary rehabilitation or medical specialists. The team has the ability to highlight and account for all of our clients’ catastrophic injuries. By working with medical experts as early as possible, we educate ourselves about all of the medical issues that are present in our clients’ cases.

In preparing trucking accident cases for trial, our firm also engages high-tech tools to present the mountains of evidence often present. For example, we have presented interactive graphs of a driver’s fatigue and logged activity to illustrate dangerous vehicle operation.

When Whiting Law Group agrees to represent a client in a trucking case, we commit to use all the resources necessary to properly pursue and win the case. Having made that commitment, the sense of professional accomplishment gained from successfully representing our catastrophically injured clients is amongst the greatest rewards we enjoy as trial lawyers.
